The Liability Assumption Agreement (abbreviated as HÜV) is a contract between a manufacturer (warranty partner) and the ZVSHK for the benefit of SHK member companies (§ 328 BGB). If the manufacturer's product causes a defect for the client of the member company, the member company has its own claim for replacement against the manufacturer of the product. However, the contractual defect claim of the client is only given if the material/equipment/installation was already defective at the time of contractual acceptance (Source: ZVSHK Liability Assumption Agreement, February 2016 edition).
